Al-Anfāl 8:41
The verse
And know that whatever ye take as spoils of war, lo! a fifth thereof is for Allah, and for the messenger and for the kinsman (who hath need) and orphans and the needy and the wayfarer, if ye believe in Allah and that which We revealed unto Our slave on the Day of Discrimination, the day when the two armies met. And Allah is Able to do all things. — Marmaduke Pickthall
The issue
This verse specifies the beneficiary groups of “a fifth.” It says that “a fifth” goes to the “His Apostle,” meaning Muhammad. The fifth, means the fifth part of the plunder and a fifth of what is discovered by men of minerals, precious metals, and buried treasures. The origin of the law of the fifth is rooted in the pre-Islāmic Arabic customs of the Arabian Peninsula. It was the percentage of plunder entitled to the head of the tribe as well as his entitlement to extend his influence over any piece of land. He would then declare it under his protection. Thereafter, no one was allowed to come near to the protected location without his permission. We therefore note that the verse endorses one of the common jāhilīya (pre-Islāmic) Arab practices—a practice that originated and was implemented by groups described by the Qur’ān as blasphemers and the lost, the very ones whom Muhammad came to guide to repentance. Thus, does a true prophet carry out wars and keep a percentage of the spoils according to the jāhilīya customs?
